Conditions of participation for competitions

1. introduction

The competition is organized by .simple Marketing GmbH & Co KG - hereinafter referred to as "DotSimple". It can take place on various channels (online, offline, social media, on site, etc.) and in cooperation with partners who provide prizes or services. DotSimple represents all cooperation partners. The competition is organized exclusively by DotSimple. Platforms such as Facebook/Instagram or other third-party providers used are not associated with the competition and do not enter into a legal relationship with the participants.

Participation in the competition is only possible under the conditions stated here. By participating, participants expressly accept these conditions.

2. participation in the competition

2.1 Only persons of legal age with full legal capacity who are resident in Austria are eligible to participate.

2.2 Employees of DotSimple and their close relatives are excluded from participation.

2.3 Depending on the type of competition, participation takes place via competition cards, online forms, e-mail, social media postings or in other clearly communicated ways.

2.4 Content submitted as part of the competition (e.g. texts, images, videos) may not infringe the rights of third parties. Participants must own the rights to submitted content and obtain the consent of any persons depicted. DotSimple reserves the right to remove unauthorized content and exclude participants from the competition.

2.5 Only one entry per person is permitted per competition. Multiple entries may be excluded.

2.6 The winners will be notified in writing or by telephone. Notification will only be sent to the contact details provided by the participant.

3. profits & settlement

3.1 The prizes shown in the competition (e.g. consulting services, products, vouchers, productions) are symbolic. Deviations in model, design, color or scope of services are possible.

3.2 Cash payment, exchange or transfer of the prize is excluded. Prize claims are not transferable.

3.3 If a winner does not respond within four weeks of notification, the claim expires without substitution. In this case, DotSimple reserves the right to select a new winner.

3.4 In the case of consulting or service prizes, appointments are made individually with DotSimple. A claim to specific content, implementation dates or scope only exists within the scope of the service described in the competition.

3.5 In the case of prizes in the form of productions (e.g. video, photo, graphics), DotSimple grants the winner a simple, non-transferable, temporally and geographically unlimited right of use for business purposes within the scope of the company or project specified in the course of participation in the competition. The copyright remains with DotSimple. DotSimple is entitled to use the material for its own advertising and presentation purposes (e.g. portfolio, website, social media).

3.6 In the case of voucher or travel prizes, processing takes place directly between the winner and the respective cooperation partner. DotSimple is not liable for their services.

3.7 The prizes are deemed to be a voluntary gift. Any additional costs such as travel costs, fees or charges (e.g. for car prizes) must be borne by the winner.

3.8 DotSimple assumes no liability for material or legal defects in the prizes, insofar as legally permissible. A warranty for prizes is excluded. DotSimple shall only be liable for damages caused by intent or gross negligence. Liability for physical injury or damage to health remains unaffected.

4. data protection

DotSimple collects, processes and uses participants' personal data exclusively in accordance with the applicable legal provisions, in particular the General Data Protection Regulation (GDPR) and the Austrian Data Protection Act (DSG).

The data collected as part of the competition will be used exclusively to carry out and process the competition and may be passed on to any cooperation partners for this purpose. Any further processing or disclosure will not take place without the express consent of the data subject.

Participants can revoke their consent to the processing of their personal data at any time with effect for the future. The revocation should be addressed to: office@DotSimple.io. In the event of revocation, further participation in the competition is no longer possible.

Participants have the right to information, rectification, erasure, restriction of processing, data portability and a right to object in accordance with Art. 15 to 21 GDPR. In addition, there is a right of appeal to the Austrian data protection authority (www.dsb.gv.at).

5. final provisions

5.1 Legal recourse is excluded.

5.2 DotSimple reserves the right to cancel the competition at any time for objectively justified reasons or to change the conditions of participation.

5.3 Austrian substantive law shall apply exclusively, excluding the conflict of law rules.
